The following general terms and conditions of sale (hereinafter referred to as the 'General Conditions') are exclusively valid between the company Mia First S.r.l. with registered office in Verona, Via Amerigo Vespucci 2, VAT number 04817720230 (hereinafter 'Mia First'), and any consumer (the 'consumer' being a natural person who purchases MIA FIRST products for purposes not related to their commercial, entrepreneurial, or professional activity, if carried out) hereinafter referred to as 'the Customer,' who makes online purchases on the website www.miafirstvenezia.com. The Customer declares to have read and understood the General Conditions as they are published on the website. MIA FIRST reserves the right to unilaterally adjust these General Conditions. The date of their publication on the website is equivalent to the date of entry into force.

These General Conditions regulate purchases made on the website www.miafirstvenezia.com in accordance with the provisions of the Consumer Code, Legislative Decree no. 206/2005, as amended by Legislative Decree no. 21/2014 and Legislative Decree no. 70/2003 concerning electronic commerce.

Subject Matter of the Contract

Under the regulations of these General Conditions, MIA FIRST sells to the Customer, who purchases remotely, the goods indicated and offered for sale on the website www.miafirstvenezia.com. The contract is exclusively concluded electronically, through the internet, by the Customer's access to the address www.miafirstvenezia.com. The products are sold with the characteristics described on the aforementioned website. All products are delivered with an identification tag attached with a single-use seal. The images related to the items for sale on the website www.miafirstvenezia.com are representative of MIA FIRST products and are intended to present the product. However, the illustrations may not depict all aspects of the actual product, and there may be slight chromatic or aesthetic/morphological differences, solely due to the photographic reproduction process. Such differences cannot be claimed by the Customer.

Acceptance of the General Conditions of Sale. By sending their purchase order electronically, the Customer declares to have read and accepted these General Conditions and undertakes to observe and comply with them in their relations with MIA FIRST. These General Conditions automatically apply to all purchases made by the Customer through the website www.miafirstvenezia.com.

Purchase Procedure

The Customer buys the product, the features of which are illustrated online in their respective descriptive sheets, at the price indicated therein. The contract between the Customer and MIA FIRST is considered concluded when the order placed by the Customer is correctly fulfilled, i.e., the product is delivered to the Customer's address, provided that MIA FIRST has received confirmation of payment authorization for the total amount due and/or the product's availability has been confirmed by MIA FIRST. Therefore, the order sent by the Customer will be binding on MIA FIRST only upon the occurrence of the aforementioned conditions. MIA FIRST is not responsible for data transmission network malfunctions attributable to the operator. The received purchase order will be stored in the website's database for the period necessary for its fulfillment. Before taking charge of the order, MIA FIRST will send the Customer an email confirmation of receipt of the purchase order, containing a summary of the essential characteristics of the purchased products, detailed pricing, and the payment method chosen by the Customer. The Customer must verify the content of the communication and immediately report any errors or omissions to MIA FIRST at info@miafirstvenezia.com.

Prices and Payment Terms

All product prices indicated on the website include VAT. Product prices may be subject to updates at any time by MIA FIRST. In any case, the goods will be invoiced based on the prices indicated on the website at the time the order is created and specified in the confirmation email sent by MIA FIRST to the Customer.

The customer can make the payment by choosing one of the following methods listed: Paypal; Credit Card; Bank Transfer.

MIA FIRST will not be responsible for any illegal or fraudulent use that may be made by third parties of credit cards or other means of payment at the time of purchasing the product, as at no time during the purchasing procedure is it able to know the Customer's credit card number, which, through a secure connection, is directly transmitted to the banking service provider.

Product Delivery

The delivery of products ordered by the Customer will take place using the methods selected by the Customer among those available and indicated on the website at the time of placing the order.

The products purchased on the aforementioned website are delivered in appropriate packaging to ensure their safety and integrity even during transportation. In the case of payment by credit card, there might be a variation in delivery times due to administrative checks. In the case of payment by bank transfer, the shipping times will be calculated from the date of confirmation of the credit receipt. The shipment can be tracked by the Customer on the courier's website by entering the references that MIA FIRST will communicate via email to the Customer.

Terms

The delivery term indicated in the order should not be considered exhaustive or essential for contract execution. In any case, the Customer cannot request contract resolution before 30 days have elapsed since order confirmation. No liability can be attributed to MIA FIRST for delayed or non-delivery due to force majeure (such as, for example, but not limited to, acts of war, strikes, national or local emergency states, non-functioning of transportation infrastructure, malfunctions and disruptions of the internet network, earthquakes) or unforeseen circumstances.

Customer Checks

Upon delivery of the goods by the courier, the Customer is required to check that: (a) the number of packages delivered corresponds to the one indicated on the waybill; (b) the packaging is intact, not damaged, wet, or otherwise altered, including the closing materials. Any damage to the packaging and/or a discrepancy in the number of packages must be immediately reported by the Customer, by writing a control reservation on the courier's proof of delivery. Once the courier's document is signed, the Customer cannot raise any objections regarding the external characteristics of the delivered items.

Additionally, the Customer commits to promptly verify the conformity of the received products. In the absence of communication sent by the Customer to MIA FIRST (by registered letter with acknowledgment of receipt or certified email) within 14 days of delivery, the products will be deemed accepted.

Product Availability

Product availability refers to the moment when the Customer places the order. This availability should still be considered indicative because (a) the products might be sold to other Customers before order confirmation due to simultaneous presence on the site by multiple users, and (b) there might be a computer anomaly that makes a product available for purchase when it is not.

Even after the confirmation email has been sent by MIA FIRST, instances of product unavailability may occur. In such a case, the order will be adjusted by removing the unavailable product, and the Customer will be promptly notified via email. This communication will include information about the refund process for any payments made and to be returned to the Customer.

Complaints

For any complaints or clarifications, the Customer should contact the following email address: info@miafirstvenezia.com. The Customer will be contacted for clarification within 5 working days of the request.

Warranty

MIA FIRST products are warranted for two years from delivery, provided they are used correctly and in accordance with the instructions provided by MIA FIRST. If, within two years from delivery and as a result of proper use, the Customer detects faults or defects in the purchased product, they are required to promptly inform MIA FIRST in writing at info@miafirstvenezia.com, specifying all details and attaching supporting documentation (photos/videos). If MIA FIRST finds possible defects in the product attributable to the manufacturer, it will arrange for the free collection of the item for inspection. Upon confirming the existence of the reported faults, MIA FIRST will repair and/or replace the product under warranty, covering the costs and the round-trip shipping expenses. If MIA FIRST does not identify faults attributable to the manufacturer, the company will contact the Customer, providing a cost estimate for any repairs and/or replacement of the product. This will only proceed upon the written consent of the Customer. In this case, the shipping costs will be charged to the Customer. The repair and/or replacement will be carried out after payment of the repair and shipping fees. Should the Customer request the return of the inspected item without repair and/or replacement, the shipping costs will be charged to the Customer. In the absence of communication from the Customer, MIA FIRST will not be liable for items kept in storage for more than 3 months.

Returns and Refunds

The Customer, for any reason, has the right to withdraw from the concluded contract without any penalty and without specifying the reason within fourteen (14) working days from the receipt of the purchased products. It is not possible to exchange the chosen product with another. To make a return, the Customer must send an email requesting a return to info@miafirstvenezia.com, and specific instructions on the return procedure will be provided. In any case, the returned purchased item must be sent to MIA FIRST within 14 days from the submission of the return request. The product must be returned in its original packaging, with the respective tags and seals intact. Products that have been used, altered, or damaged will not be accepted. The shipping costs for returning the product are borne by the customer. In case of withdrawal, MIA FIRST will refund the entire amount paid by the Customer (minus the shipping costs) using the same payment method used by the Customer for the purchase. It is understood that MIA FIRST will not refund the price of returned products that have been lost, stolen, or damaged during shipment to MIA FIRST. The right of withdrawal does not apply to the purchase of custom-made or personalized goods.

Intellectual and Industrial Property Rights

All content published or present on the website www.miafirstvenezia.com, including their selection and organization, as well as the site's design, solely belong to MIA FIRST and are protected by intellectual property laws and copyright. Therefore, modifying, copying, reproducing, distributing, transmitting, or disseminating the content of this site without authorization is prohibited. No one may use or allow the use of website images or content for commercial purposes. Any use for commercial exploitation by users is expressly prohibited. All trademarks and service marks used on the site belong to MIA FIRST or are used based on official rights, such as those granted under license. Unauthorized use of these marks is prohibited. Authenticity Guarantee. MIA FIRST guarantees the authenticity of all products purchased on the website www.miafirstvenezia.com.

Miscellaneous

The potential invalidity or ineffectiveness of individual provisions in these General Conditions does not affect the validity of the remaining provisions.

Applicable Law and Jurisdiction

This contract is governed by Italian law. For any disputes arising between the parties regarding the interpretation, application, and/or execution of these General Conditions, the exclusive jurisdiction shall be the Court of Verona. In the case of disputes related to the industrial and intellectual property rights of MIA FIRST, the Court of Enterprises of Venice shall have jurisdiction.
